1. Urgent
application is allowed.
2. Exemption
application is granted subject to all just legal exceptions.
3. On
the requests of learned Advocate for the applicants/accused, this bail before
arrest is converted into protective bail. Applicants/accused (1) Murad Bux, (2) Abdul Latief, (3) Gul Sheer & (4)
Muhammad Ali are present alongwith his counsel. It is inter-alia contended that
FIR has been lodged against the applicants/accused by complainant with ulterior
motives. It is inter-alia contended that applicants/accused are
prepared to surrender before the trial Court but they apprehend their arrest at
the hands of police. Serious malafide on the part of police and complainant
have been alleged.
Without
touching the merits of the case, protective bail for a period of four (04) days from today is granted to
applicants/accused (1) Murad Bux,
(2) Abdul Latief, (3) Gul
Sheer & (4) Muhammad Ali, subject to their furnishing solvent surety in the
sum of Rs.50,000/- (Rupees Fifty Thousand only) each and
P.R. bond in the like amount to the satisfaction of the Nazir of this Court.
Applicants/accused are directed to surrender before
the learned Judge Anti-Terrorism Court No.III, Karachi in the aforesaid period. This order shall cease to
have its effect after expiry of four (04) days from today or whenever the
applicants/accused surrender before the learned Judge Anti-Terrorism Court
No.III, Karachi, which one
occurs earlier. It is made clear that in case applicants/accused failed to
surrender before the concerned Court at Karachi, within the aforesaid period, their bail bond
shall stand forfeited.
Application
is accordingly disposed of.
