It is inter alia contended that petitioner side lodged FIR No.487/2023 at P.S. Preedy, Karachi for offences under sections 489-F/34, PPC against accused persons nominated in the FIR. Thereafter, it is submitted that challan has been submitted before learned Judicial Magistrate-XXV, Karachi South and NBWs have been issued against absconding accused as mentioned in the case diary dated 14.03.2024. Grievance of the petitioner is that NBWs are not being executed. Additional Prosecutor General Sindh present in Court in some other cases waives notice. It appears that in Chapter-VI of the Code of Criminal Procedure, 1898, procedure has been provided for service of process against the accused persons residing in other Provinces. This petition is disposed of with direction to the trial Court to adopt the procedure as provided in the Code of Criminal Procedure, 1898.
