1. Urgent
application is allowed.
2. Exemption
application is granted subject to all just legal exceptions.
3. It
is inter-alia contended that the applicant/accused Sahib Dino Soomro has been shown as absconder in final report
submitted before the learned Special Court (Offences in Banks) Sindh at Karachi
in 46/2015 registered at FIA Crime Circle, Hyderabad, under Sections
409/420/468/471/447-A & 109 PPC. It is inter-alia contended that applicant/accused
is prepared to surrender before the trial Court but he apprehends his arrest as
NBW has been issued against him. Serious malafide on
the part of FIA has been alleged.
Without
touching the merits of the case, protective bail for a period of four (04) days from today is granted to
applicant/accused Sahib Dino Soomro, subject to his
furnishing solvent surety in the sum of Rs.75,000/-
(Rupees Seventy Five Thousand only) and P.R. bond in the like amount to the
satisfaction of the Nazir of this Court.
Applicant/accused is directed to surrender before the learned Special Court
(Offences in Banks) Sindh at Karachi in the aforesaid period. The operation of
NBW is suspended for the period of four (04) days. This order shall cease to
have its effect after expiry of four (04) days from today or when the
applicant/accused surrenders before the learned Special Court (Offences in
Banks) Sindh at Karachi which one occurs earlier. It is made clear that in case
applicant/accused failed to surrender before the learned Special Court
(Offences in Banks) Sindh at Karachi, within the aforesaid period, his bail
bond shall stand forfeited.
Application
is accordingly disposed of.
