Sadia Nazu seeks protective
bail in Crime No. 124/2015 registered at PS Artillary
Maidan Karachi U/s. 395 PPC.
It is inter-alia contended that applicant/accused
is prepared to surrender before the trial court but apprehends her arrest as
NBW has been issued against her by the trial court. Serious malafide on the
part of the complainant and police have been alleged.
Without touching the merits of the case, protective bail
for a period of 2 days is granted to the applicant/accused, subject to furnishing
solvent surety in the sum of Rs.50,000/- (Rupees One fifty thousand Only) and
P.R bond in the like amount to the satisfaction of the Nazir of this Court. Applicant/accused is directed to surrender
before trial court. Operation of the impugned NBW is suspended for two days. This
order shall cease to have effect after expiry of 2 days or when the
applicant/accused surrenders before the Trial Court, whichever is earlier. In
case applicant/accused after grant of protective bail fails to appear before
the Trial Court in the stipulated period, her bail bond shall stand forfeited.
