The
Petitioners seek quashment of Crime No.45/2013 under section 365-B PPC of P.S Kasoki, Jehtiawala, District Hafizabad (Punjab). When counsel was confronted with the
jurisdictional implication, she contended that instead of quashment she will be
satisfied if this petition is treated as an application for protective bail and
both the petitioners are granted protective bail for a period of 30 days.
Both
the petitioners are present before us and petitioner No.1 Mst.
Madiha states that she has not been abducted by
anyone, on the contrary she, by exercising her right of freewill, has married
petitioner No.2 Yousuf Mitto,
which has led to filing of a concocted FIR against the petitioners.
Learned
AAG and DPG have no objection for the grant of protective bail
to the petitioners.
Without
touching the merits of the case, the petitioners are granted protective bail, on the basis of P.R
bond to be executed before the Nazir of this Court in the sum of Rs.15,000/- (Rupees Fifteen Thousands) each for a period of 30
days from today.
Petition
stands disposed of.
