3. The
petitioner has been issued a call up notice on 02.12.2014 by the NAB
Authorities, which relates to an inquiry against staff of BCDA and others
regarding corruption in construction of Protection Bunds at Dam Bander,
Lasbella (Case No.7481(439).
The petitioner has applied for protective bail on the
premise that he has imminent apprehension that if he will appear in response to
the call up notice, he will be arrested by the NAB Authorities, so he requests
that he may be allowed protective bail to surrender before the Balochistan High
Court and seek appropriate remedy of bail. Learned counsel has argued that in some other
call up notice issued in the same matter, this court has already granted
protective bail to some other petitioner in C.P.No.D-5262/2014.
Without
touching the merits of the case, petitioner is granted protective bail for a period of 15 days from today subject to
furnishing solvent surety in the sum of Rs.500,000/- (Rupees Five Lacs Only)
and P.R bond in the like amount to the satisfaction of the Nazir of this Court.
This
bail order will remain in force for 15 days or when the petitioner surrenders
before the Balochistan High Court, whichever is earlier. The petitioner in
response to the call up notice will appear before the I.O and cooperate in the
inquiry/investigation.
