            Learned AAG present in the Court waives notice of this Petition. Petitioner/accused has approached to this Court directly for seeking pre-arrest bail in Crime No. 285/2015 registered at P.S Darakshan, Karachi for offences under sections 342/506-B/504/186/353/34 PPC read with Section 7 of Anti-Terrorism Act 1997. Prayer for transfer of the FIR to the Court of ordinary jurisdiction has also been made. It is contended that there is genuine apprehension of imminent arrest of the Petitioner/accused for the political reasons. It is further contended that police is trying to arrest the Petitioner/accused for ulterior motives such as humiliation and unjustified harassment.

 

            Learned counsel for the Petitioner/accused, after arguing the petition at some length, requests that prayer of pre-arrest bail may be converted to protective bail. Such request is allowed.

 

            Without touching the merits of the case, protective bail is granted to the petitioner/accused for a period of 03 (three) days subject to furnishing solvent surety in the sum of Rs.100,000/- (Rupees One Lac only) and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Petitioner/accused is directed to surrender before the trial court in the aforesaid period. This order shall cease to have effect after expiry of three days. Petition to the extent of protective bail is disposed of in the above terms.

 

            As regards to the prayer for transfer of the aforesaid FIR to the ordinary Court is concerned, learned counsel for the Petitioner/accused seeks time for preparation. Time is allowed. Let notice be issued to learned P.G for 28th May 2015.
