1.         Urgent application is allowed.

 

2.         Exemption application is granted subject to all just legal exceptions.

 

3.         On the request of learned counsel for the applicant/accused, pre-arrest bail application is converted to protective bail. It is inter-alia contended that application for pre-arrest bail of applicant/accused has been dismissed by Trial Court in non-prosecution and NBWs have been issued against him. It is further contended that absence of the applicant/accused on 23.11.2015 was neither deliberate nor intentional but absence of the applicant/accused was due to misunderstanding of the date of hearing.

           

 

            Without touching the merits of the case, protective bail for a period of four (04) days from today is granted to applicant/accused Sultan Ahmed Shaikh son of Khursheed Ahmed Shaikh, subject to his furnishing solvent surety in the sum of Rs.200,000/- (Rupees Two Lacs only) and P.R. bond in the like amount to the satisfaction of the Nazir of this Court. Applicant/accused is directed to surrender before the learned Special Court (Offences in Banks) Sindh at Karachi in the aforesaid period. The operation of NBWs is suspended for the period of four (04) days. This order shall cease to have its effect after expiry of four (04) days from today or when the applicant/accused surrenders before the learned Special Court (Offences in Banks) Sindh at Karachi which one occurs earlier. It is made clear that in case applicant/accused failed to surrender before the learned Special Court (Offences in Banks) Sindh at Karachi, within the aforesaid period, his bail bond shall stand forfeited.

 

            Application is accordingly disposed of.
