Gazain Khan Marri seeks transitory/protective bail in FIR No. 04/2000 registered
against him and others at P.S Bijli Road, Quetta for offence under Sections 302/324/427/120-B/109/34
PPC. Learned Advocate for the applicant/accused submits that proceedings
against Nawab Khair Bux Marri and others have been stopped and proceedings have
been kept in abeyance in Sessions Case No. 02/2000 by learned Sessions Judge/
STA Judge, Quetta vide order dated 22.07.2010. Mr. Z.U.Mujahid learned counsel
appearing on behalf of the applicant/accused submits that this application for
bail is filed by the son of the applicant/accused and applicant/accused now
intends to come to Pakistan to surrender before trial Court in the aforesaid
crime/case. N.B.Ws have been issued against the applicant/accused. Learned
Advocate for applicant/accused along with the bail application has filed copy
of the passport of accused. Presently, it is stated that applicant/accused is
at Dubai.
Without
touching the merits of the case, only in order to enable the applicant/accused
Gazain Khan Marri to approach the trial Court, he is granted
protective/transitory bail for a period of 10
days from today, upon furnishing solvent surety in the sum of
Rs.10,00,000/- (Rupees Ten Lacs Only) and P.R bond in the like amount to the
satisfaction of the Nazir of this Court. In case applicant/accused fails to
surrender before the Trial Court in the aforesaid period, his bail bond shall
stand automatically forfeited.
Instant
Criminal Bail Application No. 1422/2017 stands disposed of.
