Applicants/accused
Usman Ghani Pal, Shoaibuddin and Mohammad Siddique are present along with their
counsel and seek protective bail in FIR No.292/2017 registered at Police
Station Sukkan, Malir, for offences under sections 147/ 148/ 149/ 353/ 186/
384/ 385/ 337-H(ii) /337-A(i) PPC read with Section 7 of the Anti-Terrorism
Act, 1997. It is inter-alia contended that applicants/accused have been
involved in this case by the complainant for malafide reasons. It is further
argued that applicants/accused are prepared to surrender before the Trial
Court, but apprehend their arrest at the hands of police with the ulterior
motives.
Without
touching merits of the case, protective
bail for a period of 05 days is
granted to the applicants/accused Usman Ghani Pal, Shoaibuddin and Mohammad
Siddique, subject to their furnishing solvent surety in the sum of Rs.100,000/-
(Rupees One Lac) each and P.R bond in the like amount to the satisfaction of
the Nazir of this Court. Applicants/accused shall surrender before the learned
Judge, Anti-Terrorism Court No.I, Karachi in the aforesaid period. This order
shall cease to have effect after expiry of 05
days or whenever the applicants/accused surrender before the concerned
Court, whichever is earlier. In case, applicants/accused fail to surrender
before the Trial Court within the stipulated period, their bail bonds shall
stand forfeited automatically.
The instant
Criminal Bail Application No.1499 of 2017 stands disposed of.
