Applicant/accused
Mohammad Arsalan seeks protective bail in FIR No.125/2016 for offences under
Sections 353/324/34 PPC and 3/4 Explosive Substances Act, 1908 read with
Section 7 of the Anti-Terrorism Act, 1997, registered at Police Station CTD
Garden, Karachi. Counsel for the applicant/accused submits that
applicant/accused is prepared to surrender before the learned Judge,
Anti-Terrorism Court No.VII Karachi, but apprehends his arrest as NBWs have
been issued against him. Serious malafide on the part of police has been
alleged.
Without
touching merits of the case, protective
bail for a period of 03 days is
granted to the applicant/accused Mohammad
Arsalan, subject to furnishing solvent surety in the sum of Rs. 50,000/-
(Rupees Fifty Thousand only) and P.R bond in the like amount to the
satisfaction of the Nazir of this Court. Operation of NBWs issued against the
applicant/accused is also suspended for 03
days. Applicant/accused shall surrender before the learned Judge,
Anti-Terrorism Court No.VII, Karachi, in the aforesaid period. This order shall
cease to have effect after expiry of 03
days or whenever the applicant/accused surrenders before the concerned Court.
In case, applicant/accused fails to surrender before the Trial Court within the
stipulated period, his bail bond shall stand forfeited automatically.
The
instant Bail Application stands disposed of.
