            Applicant/accused Zia-ul-Haq Khowaja seeks protective bail in FIR No.20/2017 registered at P.S. FIA Crime Circle, Hyderabad under Sections 34, 409, 420, 468, 471, 477-A PPC. It is stated that presently case is pending before learned Special Court (Offences in Banks) Sindh at Karachi.

 

            It is inter-alia contended that applicant/accused is prepared to surrender before the Trial Court but apprehends his arrest with ulterior motive at the hands of FIA on the way to the trial Court as NBWs have been issued against him. Serious malafide on the part of FIA has been alleged. It is also pointed out by learned counsel for the applicant/accused that co-accused Mushtaq Ali Khowaja has already been granted protective bail by this Court in Criminal Bail Application No. 1740/2017 dated 13.11.2017.

 

            Without touching merits of the case, protective bail for a period of 04 days is granted to the applicant/accused Zia-ul-Haq Khowaja, subject to furnishing solvent surety in the sum of Rs.100,000/- (Rupees One Lac only) and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Operation of NBWs issued against the applicant/accused is also suspended for 04 days. Applicant/accused is directed to surrender before the trial Court in the aforesaid crime. This order shall cease to have effect after expiry of 04 days or whenever the applicant/accused surrenders before the concerned Court. In case, applicant/accused fails to surrender before the Trial Court within the stipulated period, his bail bond shall stand forfeited automatically.

 

            The instant Bail Application stands disposed of.
