Applicant/accused
Guftar son of Muhammad Jam seeks protective bail in FIR No.29/2019 registered
at P.S Mohabat Dero Jatoi District Naushero Feroz for offences under sections
302/324/149/386 PPC read with Section 7 of the Anti-Terrorism Act, 1997. It is
inter-alia contended that applicant/accused is prepared to surrender before the
trial Court, but apprehends his arrest on the way to the Court of learned
Judge, Anti-Terrorism Court Naushero Feroz. Serious malafide on the part of
police is alleged.
Without
touching merits of the case, protective
bail for a period of 07 days is
granted to the applicant/accused Guftar, subject to his furnishing solvent
surety in the sum of Rs.50,000/- (Rupees Fifty Thousand only) and P.R bond in
the like amount to the satisfaction of the Nazir of this Court.
Applicant/accused shall surrender before the learned Judge, Anti-Terrorism
Court Naushero Feroz, in the aforesaid period. This order shall cease to have
effect after expiry of 07 days or
whenever the applicant/accused surrenders before the concerned Court. In case,
applicant/accused fails to surrender before the Trial Court within the
stipulated period, his bail bond shall stand forfeited automatically.
The
instant Bail Application stands disposed of.
