This
is an application for protective bail moved on behalf of applicants/accused Muhammad
Ashraf Qureshi and Qadir Bux in Crime No.159/2019 registered at P.S Manghopir
for offences under sections 353/ 324/ 435/ 427/ 147/ 148/ 149/ 447/ 337-A(i)
PPC read with Section 7 Anti-Terrorism Act, 1997. Applicant/accused Muhammad
Ashraf Qureshi is present before this Court. Counsel appearing for the
applicants/accused does not press the bail application for accused Qadir Bux as
he is called absent. Protective bail application to the extent of accused Qadir
Bux is dismissed as not pressed.
It is
contended that applicant/accused Muhammad Ashraf Qureshi is prepared to
surrender before the learned Judge, A.T.C concerned, but apprehends his arrest
at the hands of the police for the malafide reasons. Serious malafide on the
part of the police is alleged.
Without
touching merits of the case, protective
bail for a period of 04 days is
granted to the applicant/accused Muhammad Ashraf Qureshi, subject to his
furnishing solvent surety in the sum of Rs.50,000/- (Rupees Fifty Thousand
only) and P.R bond in the like amount to the satisfaction of the Nazir of this
Court. Applicant/accused Muhammad Ashraf Qureshi shall surrender before the
learned Judge, Anti-Terrorism Court concerned, in the aforesaid period. This
order shall cease to have effect after expiry of 04 days or whenever the applicant/accused surrenders before the
concerned Court. In case, applicant/accused fails to surrender before the Trial
Court within the stipulated period, his bail bond shall stand forfeited
automatically.
The
instant Bail Application stands disposed of.
