            Through this constitution petition under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973, filed by petitioner/accused Muhammad Abid son of Haji Muhammad Hussain, through his attorney, namely, Khurram son of Muhammad Yaqoob, seeks protective-cum-transitory bail in FIR No.19/2023, registered at P.S. FIA, Anti-Corruption Circle, Karachi for offences sections 5(2) PCA, 1947, read with Sections 156(8)(89) of the Customs Act, 1969 and 190, PPC.

            It is submitted that at present petitioner is at Dubai and is prepared to surrender before trial Court(s)/Special Judge, Customs & Taxation at Karachi and Special Judge, Anti-Corruption (Central-I) Sindh at Karachi but he apprehends his arrest at the hands of FIA officials at Jinnah International Airport Karachi as NWB has been issued against him. Counsel for petitioner submits that petitioner is scheduled to arrive at Jinnah International Airport, Karachi on 20.05.2024. Serious mala fide on the part of FIA officials has been alleged.  

Since the petitioner/accused is prepared to surrender before the trial Court(s), without touching the merits of the case, petitioner/accused Muhammad Abid son of Haji Muhammad Hussain is granted protective-cum-transitory bail for a period of sever (7) days from today, subject to his furnishing two solvent sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand) each and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Operation of NBW issued against the petitioner is suspended for seven days from today. Petitioner/accused is directed to surrender before the trial Court(s) concerned in the aforesaid period. This order shall cease to have its effect after expiry of seven days from today or whenever the petitioner/accused surrenders before the trial Court(s), which one occurs earlier. In case, petitioner fails to surrender before the trial Court(s) within the aforesaid period, his bail bond(s) shall stand automatically forfeited. Let the copy of this order be sent to the Secretary, Ministry of Interior, Government of Pakistan, Islamabad, by fax for compliance.

            The instant petition is accordingly disposed of.
