Applicant/accused Muhammad Razzaq Ali seeks protective bail in Crime No.170/2012 registered at P.S Napier for offences under sections 324/302/34 PPC read with section 7 Anti-Terrorism Act, 1997. Presently case is pending before learned Judge, Anti-Terrorism Court No. VI, Karachi. It is inter-alia contended that applicant/accused has no knowledge regarding registration of the FIR and submission of the challan against him. It is further stated that main accused namely Umair Ahmed, Asif Butt and Bilal @ Kodu have already been acquitted by the trial Court and applicant/accused is prepared to surrender before the trial Court but apprehends his arrest as NBWs have been issued against applicant/accused. Serious malafide on the part of police has also been alleged.

 

            Without touching merits of the case, protective bail for a period of 04 days is granted to the applicant/accused Muhammad Razzaq Ali, subject to his furnishing solvent surety in the sum of Rs.50,000/- (Rupees Fifty Thousand only) and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Operation of NBWs issued against the applicant/accused is also suspended for a period of 04 days. Applicant/accused is directed to surrender before the trial Court in the aforesaid period. This order shall cease to have effect after expiry of 04 days or whenever the applicant/accused surrenders before the concerned Court. In case, applicant/accused fails to surrender before the Trial Court within the stipulated period, his bail bond shall stand forfeited automatically.

 

            The instant Bail Application stands disposed of.
