Applicant/accused Attar Khan son of Habibullah Khan seeks
protective bail in Crime No.169/2019 registered at P.S Peerabad for offences
under sections 302/324/34 PPC read with Section 7 Anti-Terrorism Act, 1997. Learned
counsel for the applicant/accused pointed out that applicant/accused has been
granted interim pre-arrest bail by learned Judge, Anti-Terrorism Court No.II,
Karachi in the above referred FIR for offences under section 324/34 PPC read
with section 7 Anti-Terrorism Act, 1997, now injured has expired and police has
added section 302 PPC. It is apprehended that by addition of section 302 PPC
police will arrest applicant/accused in above case. It is submitted that
applicant/accused is prepared to surrender before the Trial Court but
apprehends his arrest at the hands of the police for malafide reasons. Serious
malafide on the part of complainant and police has been alleged.
Without
touching merits of the case, protective
bail for a period of 03 days is
granted to the applicant/accused Attar Khan son of Habibullah Khan, subject to
his furnishing solvent surety in the sum of Rs.100,000/- (Rupees One Lac only)
and P.R bond in the like amount to the satisfaction of the Nazir of this Court.
Applicant/accused is directed to surrender before learned Judge, Anti-Terrorism
Court No.II Karachi in the aforesaid period. He will also join the
investigation forthwith. This order shall cease to have effect after expiry of 03 days or whenever the
applicant/accused surrenders before the concerned Court. In case,
applicant/accused fails to surrender before the Trial Court within the
stipulated period, his bail bond shall stand forfeited automatically.

Bail Application stands disposed of.
