Applicant/accused
Muhammad Asif son of Muhammad Rasheed seeks protective in FIR No.14/2016 for
offences under Sections 392/353/324/34 PPC read with section 7 Anti-Terrorism
Act, 1997, registered at Police Station Shah Faisal Colony Karachi. Counsel for
the applicant/accused submits that presently case is pending before
Anti-Terrorism Court-XV Karachi, where NBWs have been issued against the
applicant/accused. Counsel for the applicant/accused submits that
applicant/accused is prepared to surrender before the Trial Court, but
apprehends his arrest as NBWs have been issued against him. Serious malafide on
the part of police and complainant has been alleged.
Without
touching merits of the case, protective
bail for a period of 04 days is
granted to the applicant/accused Muhammad Asif son of Muhammad Rasheed, subject
to furnishing solvent surety in the sum of Rs.30,000/- (Rupees Thirty Thousand
only) and P.R bond in the like amount to the satisfaction of the Nazir of this
Court. Operation of NBWs issued against the applicant/accused is also suspended
for 04 days. Applicant/accused shall
surrender before the learned Judge, Anti-Terrorism Court No.XV, Karachi, in the
aforesaid period. This order shall cease to have effect after expiry of 04 days or whenever the
applicant/accused surrenders before the concerned Court. In case,
applicant/accused fails to surrender before the Trial Court within the
stipulated period, his bail bond shall stand forfeited automatically.
The
instant Bail Application stands disposed of.
