Applicant/accused Abdul Samad
seeks protective bail in Crime No. 834/2024 for offences punishable under
sections 420, 408, 34 PPC registered at PS Aziz Bhatti,
Karachi. It is inter-alia contended that there was business transaction in
between applicant/accused and the complainant; that due to dispute, FIR has
been registered against the applicant/accused. It is further contended that applicant/accused
intends to surrender before trial Court but apprehend his arrest at the hands
of police. Serious malafide on the part of
complainant and police is alleged.
Since applicant/accused is prepared to
surrender before the trial court, without touching merits of the case, applicant/accused
Abdul Samad son of Tehseen
Ahmed is granted protective bail for
a period of four (04) days from
today, subject to his furnishing solvent surety in the sum of Rs.50,000/-
(Rupees Fifty Thousand Only) and P.R. bond in the like amount to the
satisfaction of the Nazir of this Court. Applicant/accused
is directed to surrender before the concerned trial Court in the aforesaid
crime/case. This order shall cease to have its effect after expiry of (04) days from today or when the applicant/accused
surrenders before the concerned trial Court, which one occurs earlier. It is
made clear that in case applicant/accused fails to surrender before the
concerned trial Court within the aforesaid period his bail bond shall stand
forfeited automatically.
Instant bail application is accordingly
disposed of.
