Applicant/accused
Faqeer Khan son of Shahzada is present along with his counsel. He seeks
protective bail in FIR No.56/2024, registered
at P.S. ANF Muhammad Ali Society, Karachi for offence under section 9(1) Serial
No.3(8) of the Control of Narcotic Substances Act,
1997. It is inter alia contended that
applicant’s actual name is Faqeer Muhammad not Faqeer Khan and he has been falsely been implicated in this
case on the statement of co-accused. He was not aware about pendency of instant
case therefore he could not surrender before the trial Court concerned. It is further
contended that NBW has been issued against the applicant/accused and he is prepared
to surrender before the trial Court. Serious mala fides on the part of the ANF police
have been alleged.
Without touching the merits of the case, protective bail is granted to
applicant/accused Faqeer Khan (Faqeer Muhammad)
son of Shahzada, having CNIC No.42301-4199028-9, for
a period of four (04) days from
today, subject to furnishing solvent surety in the sum of Rs.25,000/- (Rupees twenty five thousand) and P.R bond in the like amount
to the satisfaction of the Nazir of this Court. Operation of NBW issued against
the applicant/accused is suspended for four days. Applicant/accused is directed
to surrender before the trial Court in the aforesaid period. This order shall
cease to have its effect after expiry of four days from today or whenever the applicant/accused
surrenders before the trial Court, which one occurs earlier. It is made clear,
in case, applicant/accused fails to surrender before the trial Court in the
aforesaid period, their bail bond shall stands automatically forfeited.
The instant
criminal bail application is accordingly disposed
of.
