Applicant/accused
Iqbal son of Muhammad Rafiq Khan is present along with his counsel. He seeks
protective bail in FIR No.1073/2024, registered
at P.S. SITE Superhighway, Karachi for offence under sections 302, 324, 147,
148, 149, 34, PPC. It is inter alia contended
that applicant/accused is innocent and apprehends his arrest in the aforesaid
FIR at the hands of police officials for mala fide reasons. Serious mala fides
on the part of police officials and complainant have been alleged.
Without touching the merits of the case, protective bail is granted to
applicant/accused Iqbal son of Muhammad Rafiq Khan, for a period of four (04) days from today, subject to
furnishing solvent surety in the sum of Rs.50,000/-
(Rupees fifty thousand) and P.R
bond in the like amount to the satisfaction of the Nazir of this Court. Operation
of NBW issued against the applicant/accused is suspended for four days. Applicant/accused
is directed to surrender before the trial Court in the aforesaid period. This
order shall cease to have its effect after expiry of four days from today or
whenever the applicant/accused surrenders before the trial Court, which one
occurs earlier. It is made clear, in case, applicant/accused fails to surrender
before the trial Court in the aforesaid period, their bail bond shall stands
automatically forfeited.
The instant
criminal bail application is accordingly disposed
of.
