Applicant/accused
Azizullah son of Sanak Khan
is present along with his counsel. He seeks protective bail in FIR No.54/2021, registered at P.S. Mubina Town, Karachi East, for offence under section 395
PPC. It is inter alia contended that
applicant/accused had no knowledge regarding pendency of the case against him,
when he came to known regarding registration of the aforesaid FIR, he prepared
to surrender before the trial Court but he apprehends his arrest at the hands
of police officials for mala fide reasons. Serious mala fides on the part of
police officials and complainant have been alleged.
Without touching the merits of the case, protective bail is granted to
applicant/accused Azizullah
son of Sanak Khan, for a period of five (5) days from today, subject to
furnishing solvent surety in the sum of Rs.40,000/-
(Rupees forty thousand) and P.R
bond in the like amount to the satisfaction of the Nazir of this Court. Operation
of NBW issued against the applicant/accused is suspended for five days. Applicant/accused
is directed to surrender before the trial Court in the aforesaid period. This
order shall cease to have its effect after expiry of five days from today or
whenever the applicant/accused surrenders before the trial Court, which one occurs
earlier. It is made clear, in case, applicant/accused fails to surrender before
the trial Court in the aforesaid period, their bail bond shall stands
automatically forfeited.
The instant
criminal bail application is accordingly disposed
of.
