Applicant/accused
Iqbal Khan son of Shams-ur-Rehman is present along with his
counsel. He seeks protective bail in FIR No.667/2020, registered at P.S. Sukhan, Karachi, for offence under section 23(1)(a) of the Sindh Arms Act, 2013. It is submitted that the
applicant/accused had obtained bail from the trial Court but he absconded as he
has life threat due to enmity. Now it is stated that the applicant/accused is
prepared to surrender before the trial Court but he apprehends his arrest as
NBW has been issued against him. Serious mala fides on the part of police have
been alleged.
Without touching the merits of the case, protective bail is granted to
applicant/accused Iqbal Khan son of Shams-ur-Rehman, for a period of four (4) days from today, subject to furnishing solvent surety in
the sum of Rs.60,000/- (Rupees sixty thousand) and P.R bond
in the like amount to the satisfaction of the Nazir of this Court. Operation of
NBW issued against the applicant/accused is suspended for four days. Applicant/accused
is directed to surrender before the trial Court in the aforesaid period. This
order shall cease to have its effect after expiry of four days from today or
whenever applicant/accused surrenders before the trial Court, which one occurs
earlier. It is made clear, in case, applicant/accused fails to surrender before
the trial Court in the aforesaid period, his bail bond shall stands
automatically forfeited.
The instant
criminal bail application is accordingly disposed
of.
