            Applicant/accused Muhammad Zubair Moallam son of Nooruddin is present along with his counsel. Applicant/accused has filed this criminal bail application for grant of pre-arrest bail in FIR No.85/2020, registered at P.S. Clifton, for offence under section 420/406, PPC. Prior to this, applicant/accused applied for the same relief before learned Additional Sessions Judge-X, Karachi South, the same was declined vide order dated 07.07.2021. Counsel for applicant/accused submits that challan has been submitted against the applicant/accused before the competent Court of law and NBW has been issued against him. In these circumstances, it is prayed that this bail before arrest application, may be converted to protective bail so that the applicant/accused may be able to surrender before the trial Court for seeking the remedy available to him under the law. Orders accordingly.

 

Without touching the merits of the case, protective bail is granted to applicant/accused Muhammad Zubair Moallam son of Nooruddin, for a period of six (6) days from today, subject to furnishing solvent surety in the sum of Rs.30,000/- (Rupees thirty thousand) and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Operation of NBW issued against the applicant/accused is suspended for six days from today. Applicant/accused is directed to surrender before the trial Court in the aforesaid period and join the trial forthwith. This order shall cease to have its effect after expiry of six days from today or whenever applicant/accused surrenders before the trial Court, which one occurs earlier. It is made clear, in case, applicant/accused fails to surrender before the trial Court in the aforesaid period, his bail bond shall stands automatically forfeited.

 

            The instant criminal bail application is accordingly disposed of.
