Hussain Shah has placed on record certified copies of
depositions of PWs Nos.1 and 2, namely, Ali Hasan Hingoro and Mashooq Ali and
submits that the trial is in progress. It is further informed that material
evidence has been recorded but at present learned trial Judge has proceeded to
perform Umrah. Counsel for applicant/accused submits
that he would be satisfied and does not press instant criminal bail
application, if directions are issued to the trial Court for expeditious
disposal of the case. Learned DDPP has recorded no objection for issuance of
such directions.
In the view of above, instant criminal bail applications are
dismissed as not pressed. However, trial Court is directed to decide the case
expeditiously, preferably within a period of two months, under intimation to
this Court.
