            M/s Abdul Rauf Malik & Abdul Jalil, advocates a/w applicant/accused

            Applicant/accused Azmat Khan son of Raees Khan is present along with his counsel. Counsel for applicant/accused submits that this bail before arrest application, in FIR No.218/2021, registered at P.S. Ibrahim Hyderi, for offence under Section 6/9(c) of the Control of Narcotic Substances Act, 1997, may be converted to protective bail as the applicant/accused is prepared to surrender before the trial Court but he apprehends his arrest at the hands of police for mala fide reasons. Serious mala fides on the part of police have been alleged.

 

Without touching the merits of the case, protective bail is granted to applicant/accused Azmat Khan son of Raees Khan, for a period of five (5) days from today, subject to furnishing solvent surety in the sum of Rs.50,000/- (Rupees fifty thousand) and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Operation of NBW issued against the applicant/accused is suspended for five days. Applicant/accused is directed to surrender before the trial Court in the aforesaid period and join the trial forthwith. This order shall cease to have its effect after expiry of five days from today or whenever applicant/accused surrenders before the trial Court, which one occurs earlier. It is made clear, in case, applicant/accused fails to surrender before the trial Court in the aforesaid period, his bail bond shall stands automatically forfeited.

 

            The instant criminal bail application is accordingly disposed of.
