Through this Criminal Revision
Application, applicant/accused Zulfiqar Ali Junejo has called in question order dated 24.02.2023 passed
by learned Special Court (Offences in Banks) Sindh at Karachi, whereby an
application under Section 249-A Cr.P.C was dismissed.
Notices of this Revision Application were
issued to the other side.
Learned advocate for the applicant/accused
submits that after filing of this Revision Application, trial Court has
recorded evidence of the complainant and according to him no incriminating
material has come on record against the applicant/accused. Therefore, he
intends to repeat similar application before the trial Court by not pressing
the instant Criminal Revision Application.
DAG as well as advocate for the
respondent No.3 recorded no objection, if directions are issued to the trial
Court to decide an application under Section 249-A Cr.P.C, if moved by the
applicant/accused afresh.
In the view of above, this Criminal Revision
Application is dismissed as not pressed. Trial Court shall decide application
under Section 249-A Cr.P.C, if moved by the applicant/accused, strictly in
accordance with law.
