Applicants/accused A amir Shaikh son of Hussain Ahmed Shaikh and Muhammad
Umair son of Ansar Ahmed,
seek bail after arrest in Crime No.233/2013, registered against the accused on
11.09.2013 at P.S. Bilal Colony, Karachi, under Sections 147, 148, 435, 427 and
34 PPC.
After usual investigation, challan was
submitted against the applicants/accused under the above referred Sections in
the Anti-Terrorism Court-II, Karachi.
Bail applications were moved on behalf
of the applicants/accused, separately, the same were rejected by the learned
Judge, Anti-Terrorism Court-II, Karachi, vide order dated 14.12.2013.
Thereafter, the applicants/accused approached this Court for seeking the same
relief.
Mr. Muhammad Akhtar
Shad, learned advocate for the applicants/accused after arguing the bail
application at some length stated that he would not press the bail application
in case, directions are issued to the trial Court for recording evidence of complainant
within a short possible period.
Mr. Khadim Hussain,
learned D.P.G. recorded no objection and stated that Investigation Officer says
that complainant would be produced before the trial Court for his evidence within
one month.
In the above stated circumstances,
bail application is dismissed as not pressed, with direction to the trial Court
to record the evidence of complainant within one month and decide the case
expeditiously. In case, prosecution failed to produce complainant before the
trial Court within one month, the applicants/accused would be at liberty to
repeat the bail application before the trial Court, the same shall be decided
by the trial Court in accordance with law.
