Through this application it is stated that Petitioner No.2 has already
undergone the sentence awarded to her. Notice of the application was issued to
the respondents. Superintendent, Special Prison for Women, Karachi was called. She
placed on record copy of letter dated 07.09.2013 sent to the Chairman, Special
Court (Commercial) Karachi, seeking clarification regarding payment of decretable amount US$ 35,650/- in Case No.03/2003 T.D.AP (EBP),
State versus S. H. Tabani and Sons under section 5(I)
of the Import and Export Control Act 1950, read with section 265(H) of Code of
Criminal Procedure. Superintendent, Special Prison for Women says that despite
repeated letters yet response from the Chairman, Special Courts (Commercial)
Karachi is awaited.
Muhammad Kamran Farooqui,
Reader of the Special Court (Commercial) Karachi is present in Court and states
that Special Court (Commercial) Karachi is lying vacant. Presently, link/Incharge Judge has not been appointed by the competent
authority that is why the clarification has not been issued to the
Superintendent, Special Prison for Women, Karachi. He further says that
whenever Special Court (Commercial) Karachi is lying vacant, usually Chairman, Special
Drug Courts, Karachi is appointed as link Judge. In these, circumstances,
Chairman, Special Drug Courts, Karachi is directed to minutely examine the
record of the case in the capacity of link Judge, Special Court (Commercial)
Karachi, decide the application submitted by the Superintendent, Special Prison
for Women, Karachi, seeking clarification vide letter dated 07.09.2013. Learned
link Judge shall reply the letter of concerned Superintendent Jail within a
period of 07 days, under intimation to this Court.
Application
is accordingly disposed of.
