Through
this Criminal Misc. Application, Advocate for the applicant/complainant seeks
directions to the trial court for expeditious disposal of the case. Notice was
issued to the accused, who are said to be confined in jail. Report was called
from the trial court, it appears that charge has been framed by the trial
court. Learned Advocate for the applicant/complainant submits that there is
serious threat to the lives of the eye-witnesses, if they depose against the
accused. It is submitted that applicant/complainant would be satisfied if the
evidence of the eye witnesses is recorded within a short possible period.
Mr.
Mohammad Iqbal Awan learned APG, recorded no objection, if directions are
issued to the trial court for expeditious disposal of the case.
Keeping
in view the submissions of learned Advocate for the applicant/complainant that
there is serious threat to the prosecution witnesses. It is duty of state to
ensure inexpensive and expeditious justice. Therefore, trial court is directed
to record evidence of the eye witnesses within two months and make all possible
efforts to dispose of the case within a period of four months.
Learned Advocate for the applicant/complainant in
view of the above directions, does not press this Criminal Misc. Application
more and it is disposed of accordingly.
