Learned
advocate for the complainant inter-alia contended that interim challan has been
submitted in FIR No. 80 of 2022 registered at PS Artillery Maidan PS for
offence under Section 420/406/34 PPC before learned Civil Judge/ Judicial
Magistrate-XIV, Karachi South, yet police has failed to submit final report. It
is further submitted that according to the police, FIA has jurisdiction in the
matter and ordinary court lacks jurisdiction in the matter.
Mr. Abrar Ali Khichi Addl. P.G argued
that during investigation, it transpired that case is exclusively trible by
Special Court (Offences in Banks) Sindh at Karachi .
Since cognizance has already been
taken by learned Civil Judge/ Judicial Magistrate-XIV, Karachi South, the point
of jurisdiction shall be determined by the trial Court on the basis of FIR, 161
Cr.P.C statements and other material collect during investigation.
In the view of above, the instant petition
is accordingly disposed of.
