          Through instant criminal bail application applicant Shakeel Ahmad son of Subhan Shah was admitted to pre-arrest bail in the sum of Rs.50,000/- and P.R bond in the like amount by this Court vide order dated 25.05.2009, with direction to the applicant to appear before the trial Court. Applicant Mst. Fahmeena Bano wife of Subhan Shah stood surety for the Applicant in the sum of Rs.50,000/- and deposited defence saving certificate of Rs.50,000/-.

 

          Copy of judgment passed by Judicial Magistrate Karachi South in Crime No.336/2009 State Vs. Shakeel Ahmad under sections 420, 468, 471 PPC, registered at P.S. City Courts is placed on record, which shows that trial Court by judgment dated 15.09.2010 convicted the accused for one year but instead of sending him to Jail his custody was handed over to the Probation Officer under section 5 of the Pakistan Probation of Offenders Ordinance 1960. Copy of letter issued by the Probation Officer is placed on record, which shows that Shakeel Ahmad remained on probation with effect from 15.09.2010 to 14.09.2011 as per orders of 1st Civil Judge and Judicial Magistrate Karachi South.

 

          Learned A.P.G. states that surety papers are no more required, therefore, Nazir of this Court is directed to return the Defence Saving Certificate of Rs.50,000/-, which is kept in safe custody, to the Applicant/Surety after proper identification and verification, in accordance with law.

 

          Application is disposed of accordingly.
