Through instant petition the petitioner has prayed that the respondents be restrained from causing any harassment to the petitioner and placing his name in the IV schedule of the Anti Terrorism Act, 1997.

Comments have been filed on behalf of Home Department wherein it has been categorically stated that petitioner’s name is not enlisted on the IV Schedule of Anti Terrorism Act 1997. Counsel says that despite this position the official respondents are continuously visiting the house of the petitioner and causing harassment. Respondent No.3 against whom these allegations have been leveled is present in Court and denies all the allegations.

In view of the fact that this petition has turned into factual controversy, therefore, we would not like to indulge or resolve such factual controversy, however, while disposing of this petition we will direct the respondents to act strictly in accordance with law and not to cause any harassment to the petitioner.
