Applicant/accused Mst. Shamo seeks transfer of
S.C.No.1293/2024 arising out of FIR No.78/2024 for offence under sections 9(i)3(d) CNS Amendment Act 2022 registered at PS Aziz Bhatti, pending before learned V-Additional Sessions
Judge/MCTC Karachi East. Transfer application is moved mainly on the ground
that trial court is lying vacant.
2. Notice was issued to P.G and Report was
called from learned Sessions Judge, Karachi East. It is reported that Court of
V-Additional Sessions Judge, Karachi East is lying vacant since 01.11.2024.
3. Counsel for the applicant/accused
submits that expeditious disposal is right of accused. Since trial Court is lying
vacant and DPG has also recorded no objection for transfer of the case to some
other Court, S.C.No. 1293/2024 is withdrawn from the
file of V-Additional Sessions Judge, Karachi East and it is made
over/transferred to the learned Sessions Judge, Karachi East for conducting
trial himself or to transfer the case to other Additional Sessions Judge,
having jurisdiction in the matter. Transfer application is allowed in the above
terms.
