Through this Constitution Petition,
petitioner Shaikh Rashid Iqbal seeks declaration that inclusion of CNIC
No.35401-5491035-1 of petitioner more than once against the names of different
persons in the list of proclaimed offenders issued in compliance of the order
passed by this Court dated 02.10.2023 in Special Cr. ATA No. 133/2020 was
result of human error, which caused several problems for the petitioner.
Notice was issued to the respondents, comments are filed by S.P Investigation Kaemari. In Para-03 of the comments, it is mentioned as
under:
“It is correct that CNIC No. 35401-5491035-1 belonging
to petitioner was wrongly mentioned thrice against the name of three different
accused persons mentioned in the consolidate list of 95 POs provided by SIO Ittehad Town in respect of POs of Ittehad
Town for which SCN bearing No.SP/INV/K/DP/2607 dated
24-05-2024 has been issued to SIO Ittehad Town for
initiating departmental action against him meanwhile enquiry was ordered to
concerned Supervisory officer DSP Investigation Saeedabad
Karachi vide No. SP/INV/DL/Legal/Br./755 dated 24-05-2024 copy of SCN and
enquiry report is attached herewith.”
AAG as
well as Addl. P.G recorded no objection for deleting the name of the petitioner
from the list of proclaimed offenders. Resultantly, we direct SP
Investigation-III, Kaemari/respondent No.4 to delete
the name having CNIC No.35401-5491035-1 of petitioner Shaikh Rashid Iqbal from the list of
absconders prepared in compliance of the order passed by this Court. Counsel
for the petitioner does not press this petition any more, it is accordingly
disposed of.
