1. Urgency granted.
2. This Constitution Petition for
protective/transitory bail was disposed of vide order
dated 19.09.2024, mainly for the following reasons:
“Since petitioner/accused Asif Manzoor son of Manzoor
Ahmed Abid is
prepared to surrender before the trial Court, without touching the merits of
the case, protective/transitory bail is granted to him for a period of Ten (10) days from today, subject to
furnishing solvent surety in the sum of Rs.50,000/- (Rupees Fifty Thousand) and P.R bond in the like
amount to the satisfaction of the Nazir of this
Court. Petitioner/accused is directed to surrender before the trial Court in
the aforesaid period. Operation of NBW issued against the petitioner is
suspended for ten days. So far as the CNIC of the petitioner/accused is
concerned, it shall be un-blocked till further orders by the trial Court. So
far as the passport of the petitioner/accused is concerned, it shall be renewed
for 10 days, thereafter, the same shall be deposited by the petitioner before
the trial Court concerned. This order shall cease to have its effect after
expiry of ten days from today or whenever the petitioner/accused surrenders
before the trial Court, which one occurs earlier. In case, petitioner fails to
surrender before the trial Court within the aforesaid period, his bail bond
shall stand automatically forfeited. Let the copy of this order
be sent to the Secretary, Ministry of Interior, Government of Pakistan,
Islamabad, by fax for information.
The instant petition is accordingly disposed of.
Counsel for the petitioner/accused
submits that surety could not be furnished before the Nazir
of this court as Nazir directed the surety to appear
in person before him for execution of the bond. It is submitted that surety at
that time was at Lahore and today surety is present before the Court. Counsel
for the petitioner/accused seeks extension of time. Counsel for the
petitioner/accused further submits that yet CNIC of the petitioner/accused has
not been unblocked. It appears that vide order dated 19.09.2024, NADRA Karachi
was directed to unblock CNIC of the petitioner/accused till further orders
passed by the trial Court/1-Judicial Magistrate, Karachi West. Let a copy of
order be dispatched to Director General NADRA Karachi for compliance.
In the above stated circumstances,
period of 07 days is extended on the same terms and conditions. Listed
application is accordingly disposed of.
