Learned counsel for the applicant states that the applicant is in abroad and has falsely been implicated in FIR No.20/2009, U/S 409,420,468,471,109 PPC R/W section 5(2) Act-II PCA 1947, P.S. FIA, C.C, Karachi. According to the learned counsel, the applicant desires to surrender and appear before the learned trial court to defend himself. It is stated by the learned counsel that if the protection is granted by this court, the applicant will appear and surrender himself before the learned trial court to defend his position. According to him, there are four cases against the applicant and he is prepared to defend all the cases before the trial court. According to Mr. Ilyas Khan, all other accused persons are enjoying bail.

Mr. Umar Hayat Sandhu, learned DAG, present in some other cases, submits that there will be no prejudice if the applicant is allowed such protection.

 

 

 

 

 

 

Under the circumstances, applicant is granted protective bail to enable him to surrender and appear before the learned Special Court (Offences in Banks) Sindh at Karachi in the subject crime within four weeks. According to learned counsel, the applicant has rapped up all his affairs abroad and such time would be needed to come over to Pakistan, therefore, such protection to be available for four weeks or up to one week after his arrival at Pakistan which ever is earlier subject to furnishing solvent surety in the sum of Rs.100,000/= and PR bond in the like amount to the satisfaction of Nazir of this Court.

Learned trial Court may pass such orders as may be appropriate without being influenced by this order of protection or quantum of the surety, which is only to secure the presence of applicant before the trial court.
