            After hearing both the parties at some length. The learned counsel for the applicant submits that he will be satisfied if the directions are issued to the concerned Judicial Magistrate to proceed in accordance with law and decide the case expeditiously as the lingering on of the case might result in humiliation to the applicants, who according to the learned counsel, have falsely been implicated in this case, due to enmity.

            Be that as it may, I am of the view that the instant application is premature and the learned counsel for the applicant has not been able to point out any patent illegality in the proceeding being carried out before the Judicial Magistrate, however, in the interest of justice, by consent of both the counsels, the learned Judicial Magistrate is directed to proceed with the case in accordance with law without any delay and decide the matter on merits expeditiously within a period of 06 months.

In view of the above, the instant case along with listed application is disposed of in the above terms.
