In compliance of the directions contained under previous order Mr.Abdul Waheed Shaikh submits details of sanctioned and vacant posts of Municipal Committee, Shikarpur, taken on record, a copy whereof is provided to the counsel for the petitioner. Per details of sanctioned and vacant posts list, in all 58 posts of different categories are lying vacant. The petitioner claims that he is matriculate, besides he knows driving. Counsel for the petitioner has drawn attention of the Court towards Sr.No.70 of the list which is post of “Fire Lorry Driver BPS-5” for which two posts are lying vacant and submits that the petitioner has no objection if he may be given appointment of said post.
When confronted, learned counsel for the respondent No.1 submits that District Recruitment Committee shall consider the appointment of the petitioner for the vacant post of Fire Lorry Driver BPS-5 as mentioned at Sr.No.70 of the list and after having necessary recommendation from the DRC shall issue appointment order/letter in favour of the petitioner under intimation to this Court.
Since number of the vacancies are lying vacant in the Municipal Committee, Shikarpur and the petitioner being eligible qualifies for the post of Fire Lorry Driver mentioned at Sr.No.70 of the list submitted by the respondents today, therefore, he deserves to be appointed for the said post.
Learned Asstt: A.G Sindh as well as learned counsel for the respondent No.1 have extended their no objection for grant of petition.
Accordingly instant petition with the above modification is hereby allowed. The Administrator/Chief Municipal Officer/respondent No.1 shall submit case of the petitioner before the Chairman, District Recruitment Committee (DRC)/Deputy Commissioner, Shikarpur within 15 days upon receipt of copy of instant order. Upon submission of the case of the petitioner by the respondent No.1, Chairman DRC shall convene the session and after making discussion over the issue involved in this case, shall recommend the case of the petitioner to the Committee in terms stated herein above. After getting approval from DRC, Municipal Officer/respondent No.1 shall issue fresh appointment order in favour of the petitioner for the vacant post of Fire Lorry Driver (BPS-05) within three months under intimation to this Court. A copy of order shall be sent by fax today to Deputy Commissioner Shikarpur as well as Municipal Officer, Municipal Committee, Shikarpur for compliance. A copy of order may also be provided to Addl. A.G Sindh for correspondence and compliance.
