At the very outset, it is stated by learned counsel for the applicant that he would not press the disposal of instant Crl.Misc.Application before this Court on merit provided the investigating officer of FIR Crime No.104/2024 of P.S. Kashmore be directed to record his version, which is not opposed by learned D.P.G for the State; however, it is opposed by learned counsel for the respondent No.1 by contending that the applicant by recording his version is attempting to defeat the investigation. If the second FIR of the incident could not be ordered to be recorded, then at least the version of the applicant could be directed to be recorded, such exercise would make the things clear.

Under the discussed circumstances, the investigating officer of the said case is directed to record a version of the applicant and then to furnish such report before the Court having jurisdiction, per law.

The instant Crl.Misc.Application is disposed of accordingly.
