IRSHAD ALI SHAH, J.- It is alleged that the applicant with the rest of the culprits, conducted a “Jirga” whereby decided a murder case, for which the present case was registered. On his involvement in such case, the applicant sought pre-arrest bail, which was granted to him; it was recalled on account of his absence without intimation before the learned Magistrate; later-on, he again sought pre-arrest bail; it was declined to him by learned 5^th Additional Sessions Judge, Larkana; it is in these circumstances, the applicant has sought pre-arrest bail from this Court by way of instant application u/s. 498-A Cr. PC.

2.        Heard arguments and perused the record.

3.        The absence of the applicant before the learned trial Court it is said was not willful but beyond his control, as he was abducted. The applicant has joined the trial and the case is on the verge of its final disposal. In these circumstances, a case for grant of pre-arrest bail to the applicant on point of further inquiry and mala fide is made out.

4.        Under the discussed circumstances, the interim pre-arrest bail already granted to the applicant is confirmed on the same terms and conditions. 

5.        The instant bail application is disposed of accordingly.
