After hearing the learned counsel, it appears that the allegation against the applicant is that he along with Zaheer Ahmed caught hold Abdul Sattar while Naseer Ahmed caused lathi blow because of that deceased Abdul Sattar died.
From the record, it appears that one Liaquat Ali has recorded his statement U/S: 161 Cr.P.C wherein he has stated that applicant along with Zaheer Ahmed was holding Abdul Sattar.
In such a situation, his bail is dismissed with the directions that the learned trial Court will record the evidence of Liaquat Ali within one month and thereafter bail application can be moved.
