IRSHAD ALI SHAH, J.- It is alleged that the applicant with the rest of the culprits, purchased a milk machine from complainant Ghulam Nabi for Rs.3200,000/-; they paid him Rs.10,00,000/- in advance and then refused to pay him rest of the amount rather threatened him to be killed in case he would demand his remaining money from them, for which the present case was registered.

 

2.        The applicant having been refused pre-arrest bail by learned 2nd Additional Sessions Judge, Kandhkot, has sought the same from this Court by way of instant application u/s. 498-A Cr. PC.

3.        Heard arguments and perused the record.

4.        The FIR of the incident has been lodged with a delay of about 14 days; such delay could not be overlooked. The offence alleged against the applicant does not fall within the prohibitory clause. Co-accused Iftikhar alias Muhammad Iftikhar with the utmost similar role has already been admitted to pre-arrest bail by this Court. The case has finally been challaned and there is no allegation of misusing the concession of interim pre-arrest bail on the part of the applicant, as such he is found entitled to be admitted to pre-arrest bail on the point of further inquiry and malafide.

5.        Under the discussed circumstances, the interim pre-arrest bail already granted to the applicant is confirmed on the same terms and conditions. 

6.        The instant bail application is disposed of accordingly.
