IRSHAD ALI SHAH - J;- It is alleged that the applicants and others were found indulged in “Rasagiri” by providing protection to notorious dacoit Nawab alias Bagi Nindwani; when he was going to be arrested, they deterred the police party of P.S Karampur, led by HC Rabban Khan from discharging its lawful duty as a public servant by making fires at them to commit their murder and then went away leaving the applicants at the spot to be apprehended by the police together with their laties, for which the present case was registered. 

2.                     The applicants having been refused bail by learned Incharge Sessions Judge, Kashmore @ Kandhkot, have sought the same from this Court by way of instant application u/s.497 Cr. PC.

3.                     Heard arguments and perused the record.

4.                     Nothing has been brought on record which may suggest that the applicants and others were found indulged in “Rasagiri”. No police personnel has sustained a fireshot injury during the encounter which appears to be surprising. There is no independent witness to the incident. The case has finally been challaned. There is no likelihood of absconsion or tampering with evidence on the part of applicants. In these circumstances, the guilt of the applicants in the commission of the incident is calling for further inquiry.

5.         Under the discussed circumstances, the applicants are admitted to bail subject to their furnishing solvent surety in the sum of Rs.50,000/- each and PR bond in the like amount, to the satisfaction of the learned trial Court.

6.         The instant criminal bail application is disposed of accordingly.
