3.         Per prosecution case the specific role for causing injuries to deceased Imdad ali is attributed to co-accused Nooruddin whereas the only allegation against the present respondents No.1 & 2 is presence/ instigation. Learned counsel for the applicant/complainant did not pin point any infirmity or illegality in the impugned order by which respondents have been admitted on bail by trial Court.

The learned Assistant Prosecutor General Sindh representing the State supported the impugned order while contending that same is just and proper and does not call for any interference.

Perusal of record reveals that no specific role has been attributed to the respondents NO.1 & 2 and mere their presence has been shown with allegation of instigation. I am unable to find out any illegality in the impugned order, as the same has been passed on the basis of settled principles of law, therefore, same does not warrant any interference by this court.

This Criminal Misc. Application No.409 of 2009 stands dismissed in limine alongwith listed applications.
