Dated; 29th August 2023

Mr. Mumtaz Ali Khan Deshmukh, Advocate for Petitioners in all petitions.

-*-*-*-*-*-

All these petitions have been filed by an individual Syed Fazil Shah Kazmi as petitioner, who claims to be a retired Director General Public Relations Sindh and resident of the locality of Scheme No.5, Kehkashan Clifton, Karachi, whereas, it has been claimed that all these petitions have been filed in the public interest as pro bono publico against illegal and unauthorized constructions and approvals in respect of multistoreyed building being erected in Scheme No.5, Kehkashan Clifton, Karachi, which according to petitioner, is purely residential area, therefore, all such constructions of multistoreyed buildings and conversion of residential to commercial plots, as well as the approvals given by the relevant authorities for construction thereon are illegal, whereas, it has been prayed that the constructions being raised thereon may be stopped and the constructions, which have already been made in violation of building regulations, may be directed to be demolished.

It has been observed that number of similar petitions have been filed by same petitioner containing vague and generalized allegations, however, without pointing out any specific violation of the Cantonment Laws and Karachi Building & Town Planning Regulations, 2002. In order to ascertain the bonafide of the petitioner, who appears to have filed number of similar petitions and claims to be a retired person, we would direct the petitioner to submit his last three years income tax returns so that it may be ascertained as to what is the source of income of the petitioner, which enables him to file such petitions by engaging the counsel. For such purpose, these matters are adjourned to 04.10.2023.
