O R D E R

Today, an application duly singed by the both the learned counsel for the parties has been filed, wherein, it has been stated that the matter has been compromised between the parties, whereas, original pay-order amounting to Rs.30 lacs has been handed over by learned counsel for the appellant to learned counsel for respondents towards final settlement of the decree dated 14.06.2017 in Suit No.724 of 1995, whereas, copy of such pay order has been annexed alongwith such application and placed on record. Both the learned counsel for the parties have prayed that instant High Court Appeal may be disposed of in view of the settlement reached between the parties.

The application appears to have been filed under Order XXIII Rule 3 read with Section 151 CPC, however, the same is not duly supported by the affidavits of the parties, therefore, the same may be treated as joint statement on behalf of the parties duly signed by their counsel. Prima facie, there seems no impediment, if the above statement filed today is taken on record and treated as compromise and final settlement between the parties and instant High Court Appeal is disposed of alongwith listed application in such terms.

Accordingly, above High Court Appeal stands disposed of alongwith listed application in above terms.
