Appellant is called absent, no intimation is received. On previous two dates of hearing also, no one was in attendance on behalf of the appellant without any intimation dspite issuance of intimation notice. Today, no one has shown appearance on behalf of the appellant, whereas, as per Bailiff’s report, it appears that the appellant has been served, however, he is not in attendance, whereas, no request for adjournment has been made.

Record shows that instant appeal was filed on 20.01.2021, however, after having filed instant appeal, the appellant and his counsel have not remained vigilant to pursue the same and appears to have lost interest in pursuing instant appeal, whereas, even the Court fee has also not been paid inspite of reasonable time granted for such purpose.

Accordingly, instant 1^st Appeal is dismissed for non-prosecution alongwith listed applications.
