Appellant and his counsel are called absent, no intimation is received. On two previous dates of hearing also, no one was in attendance on behalf of the appellant, however, the matter was adjourned in the interest of justice with caution that if, nobody appears on behalf of the appellant on the next date, instant appeal will be dismissed for non-prosecution.

Record shows that instant appeal was filed on 06.02.2021 against an impugned order dated 16.12.2020 passed by the learned Banking Court No.I at Karachi in Suit No.188 of 2020 filed by the respondent No.1, whereby, the application filed by the appellant seeking recalling of an exparte judgment dated 25.11.2020 has been dismissed by the learned Banking Court while holding that no reasonable grounds or explanation has been given by the appellant to recall the judgment and decree, as referred to hereinabove. It appears that the appellant has not remained vigilant either to pursue the suit before the learned Banking Court or before this Court in the instant appeal, as no one is coming forward on behalf of the appellant to proceed with the matter, therefore, the appellant has lost interest in pursuing instant appeal, which is accordingly dismissed on account of non-prosecution alongwith listed applications.
