2,5&6.  After arguing the matter at some length, learned counsel for the appellant does not press instant High Court Appeal, however, submits that the appellant may be allowed to agitate the factum regarding non-payment of balance sale consideration by the respondent pursuant to the sale agreement during course of hearing and arguments in the suit.

Accordingly, instant High Court Appeal stands dismissed as withdrawn in the aforesaid terms alongwith listed applications.
